Yes. I took a look at the sizing chart and he definitely isn't in the kids sizes anymore so the next up would be a men's small. If you want to be really sure measure his waist and compare it to the sizing chart to the right of the product image. This is the most accurate way to fit.

The most important measurement for pants is the waist size. At least by your height I can tell you that you fit into any pant with a regular inseam.
